The Fact of the Month Here’s something to talk about when you are discussing plan design options with your clients. Between 2008-2018, deductibles in employer-sponsored health plans went up 212%! While most people with employer coverage like their plan (68%) and feel grateful to their employer for providing coverage (72%), the higher the deductible, the more likely an individual is to have negative views of their coverage and their employer. Among those in the highest deductible plans, over half (55%) give their plan a grade of “C” or below, and half (51%) say their employer could be providing something better. Legislative Floor Action for the Week of March 26 House The House was not in session the week of March 26. Senate SB 257, PN 1596 (Ward) – Amends The Insurance Company Law establishing the Quality Eye Care for Insured Pennsylvanians Act. Requires that health insurers allow an insured to use in-network vision care providers but use out-of-network vision care suppliers for materials and optical laboratories and requires insurers to allow vision care providers to opt out of discount programs as long as they provide written disclosure to the insured that they have opted out of the discount program. Provides the Insurance Commissioner, at the commissioner’s discretion, to assess penalties for violations of this act in accordance with Pennsylvania Health Care Insurance Portability Act and the Unfair Insurance Practices Act. Further provides the Insurance Department may promulgate regulations as may be necessary or appropriate to implement act. This bill received first consideration on Tuesday, March 27. AUTO APPRAISAL BILL SIGNED BY GOVERNOR House Bill 1638 (Tobash-R-Schuylkill) was signed into law April 14, 2016 as Act 13 of 2016. This law amends the Motor Vehicle Physical Damage Appraisal Act to allow for photos to be used as documentation of a vehicle’s post-accident condition when making an appraisal. STATE BUDGET UPDATE Today, December 29, Governor Wolf signed House Bill 1460 into law as Act 10-A of 2015, bringing to a close some of the uncertainty resulting from the budget impasse. There will be more legislative action or reaction since the Governor’s veto pen was busy knocking out specific line items. While some discussions have centered on a modified pension reform proposal advanced by Republicans and apparent willingness to increase education funding, so far, there does not appear to be traction on any proposals. GOVERNOR EXPANDS CHIP BENEFITS On August 20, Governor Wolf and Insurance Commissioner Miller announced that enrollees in the Children’s Health Insurance Program (CHIP) will have their benefits expanded to meet compliance requirements of the Patient Protection Affordable Care Act (PPACA). This change will take place in December. Background: Early in the Wolf Administration, HHS determined that 3,600 children enrolled in the CHIP Buy-In (meaning that they pay the full premium rather than receiving a taxpayer subsidy) did not have PPACA-compliant coverage and would have to pay fines for 2014 and 2015. GENERAL ASSEMBLY SUSPENDS WORK FOR SUMMER Given the measure of differences between Democratic Governor Tom Wolf and Republicans in the House and Senate over state spending and whether or not to levy additional taxes, neither House nor Senate will be in session for much of the summer. MEDICAID EXPANSION MOVES THROUGH COMMITTEE In somewhat of a surprise, the House Human Services Committee reported a bill 12-11 to expand Medicaid coverage in line with the Patient Protection Affordable Care Act (PPACA) to 133% of the Federal Poverty Level. House Bill 1492 (DiGirolamo-R-Bucks) was reported out June 4 thanks to three Republican votes (DiGirolamo, Tom Murt (MontgomeryCounty) and Joe Hackett (DelawareCounty) plus all Democrats. April which is normally a big month in collections proved disappointing. PA collected $3.4 billion in general revenue which was $328.3 million or 8.8% less than anticipated. YTD collections were $23.9 billion by April 30 or 1.7% below projections. This apparently does not take into account a recent court decision that reinstated PA’s share of Tobacco Settlement money.
